Enquire Engine Licence

01Parties

This licence is between Koala Digital Pty Ltd (ABN 39 614 832 450, ACN 614 832 450) ("the Licensor", "we", "us"), which licenses and distributes the Enquire Engine, and the business that holds an Enquire Engine Licence ("the Business", "you"). It applies to every Enquire Engine and takes effect from 26 October 2026.

02What you are licensed

The Enquire Engine (enquire.page) is licensed to you, not sold. Each engine is one business's pages, forms, dashboard, alerts, tracking and storage, running on our platform at an address on enquire.page or on your own domain.

The licence gives you the right to use your engine for your own business while the licence is paid. It doesn't give you the software, templates or infrastructure behind it, and you may not copy, resell or sublicense them.

03The licence fee

The licence is $99 a month per engine, billed automatically each month, or $990 a year per engine, paid in advance. Prices are in Australian dollars and include GST.

The fee pays for the platform: hosting, software, storage, updates and support for the engine. It does not include design, setup, advertising management or consulting.

04Term and renewal

A monthly licence continues until either of us gives 30 days' written notice. An annual licence runs for its year and renews for another year unless you tell us otherwise before it ends.

05What the engine is responsible for

The engine is reliable, managed infrastructure. We keep it hosted, secure and up to date; capture and store every enquiry, form and attachment it receives; back it up daily; and monitor it.

We aim for the engine to be available at all times, but there may be short planned maintenance, or outages caused by providers outside our control (such as hosting, email or internet services). When something goes wrong, we fix it as quickly as we reasonably can.

06Your responsibilities

You are responsible for your business and every decision in it: your offers, prices and guarantees; the claims your pages and ads make; the services you provide; how quickly and how well you answer enquiries; and your advertising budgets. You confirm your pages and offers comply with the law, including the Australian Consumer Law.

Advertising spend (fuel) is paid by you directly to Google, Meta and any other ad platform, through your own accounts. It is not part of the licence.

07Fair use

Use your engine for your own lawful business. Don't use it to send spam, to collect information people haven't agreed to give you, or to host anything unlawful, misleading or that you don't have the right to use. We may suspend an engine that does, and will tell you why.

08Accounts, data and ownership

Your ad accounts, Google Business Profile and domain are in, or connected to, your name and remain yours. Your enquiries and customer data are yours. Your brand, photos and the words written for your business are yours.

The engine itself (its software, templates and infrastructure) remains the Licensor's and is licensed to you while your licence is paid.

When you connect your Google or Meta accounts, you authorise us to access them for your engine only, as the Privacy Policy describes. You can disconnect them at any time.

09Privacy

Enquiries and attachments captured by the engine are your customers' personal information. We handle it only to run the engine, store it securely, don't sell or share it, and comply with the Privacy Act 1988 (Cth). You are responsible for your own privacy policy and for how your team uses the information.

10Ending the licence

When your licence ends, the engine stops at the end of the period you have paid for. On request within 30 days, we export your enquiries and attachments in a common format within 14 days and help transfer your accounts and domain. After that, the engine and its data may be deleted.

11Results

The engine captures and tracks enquiries, but how many enquiries and jobs you get depends on your offers, prices, budgets, market, season and follow-up, which are yours to drive. We don't guarantee a particular number of enquiries, jobs or sales.

12Liability

To the extent permitted by law, our total liability under this licence is limited to the licence fees you have paid us in the three months before the claim, and we are not liable for indirect loss, such as lost profits or lost jobs. Nothing in this licence excludes rights you have under the Australian Consumer Law.

13Changes and governing law

We may update this licence for future licence periods with 30 days' written notice. This licence is governed by the laws of New South Wales, Australia.

The Terms of Service and the Privacy Policy also apply to your engine. Where they differ from this licence, this licence applies.
